3. User Responsibilities

You are solely responsible for: • Ensuring compliance with HIPAA, GDPR, and local healthcare regulations • Obtaining proper patient consent for data storage and processing • Maintaining data security and implementing additional safeguards if required • Notifying us immediately of any data breach or unauthorized access • Ensuring all data entered is accurate and legally obtained
6. Payment & Billing
• Subscription Plans: You choose a plan upon signup (Starter, Growth, Professional, or Agency) • Billing Cycle: Charged monthly or annually according to your selected plan • Payment Method: You authorize us to charge your provided payment method • Automatic Renewal: Subscriptions auto-renew unless canceled before the renewal date • Price Changes: We may change prices with 30 days' notice; continued use constitutes acceptance • Refunds: According to the plan terms (typically 30-day money-back guarantee on paid plans) • Late Payments: Accounts with overdue payments may be suspended or terminated
7. Acceptable Use Policy

8. Service Availability & SLA
ClinicsSaaS commits to: • 99.5% uptime availability for production services • Best-effort disaster recovery and data backup • Scheduled maintenance notifications (48 hours notice when possible) • Emergency hotline support for critical issues However, we do NOT guarantee: • Uninterrupted service (brief outages may occur) • Specific performance levels (response times vary with load) • Third-party service reliability (WhatsApp API, payment processors, etc.)
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW: • ClinicsSaaS is provided "AS IS" without any warranties, express or implied • We disclaim liability for indirect, incidental, consequential, or punitive damages • Our total liability to you is limited to fees paid in the past 12 months • We are not liable for third-party service failures, data loss, or business interruption • You assume all risk associated with patient data stored on our platform
10. Indemnification
You agree to defend and indemnify ClinicsSaaS against any claims, damages, or losses arising from: • Your use of the Service in violation of these Terms • Your violation of any applicable law or regulation • Your infringement of third-party intellectual property rights • Your misuse of patient data or breach of HIPAA/GDPR • Disputes between you and your patients regarding our Service
11. Termination
Termination by You: You may cancel your subscription at any time through your account settings or by contacting support. Your access will end at the end of your current billing period. Termination by Us: We may terminate your access immediately if you: • Violate these Terms or our Acceptable Use Policy • Engage in illegal or harmful activity • Fail to comply with healthcare regulations • Engage in payment fraud or chargeback abuse Upon termination, you retain access to export your data for 30 days.
12. Disclaimer of Warranties
